Employees have time till February 9 to decide on the offer, delaying which workers will receive a severance amount prescribed by labour laws the next morning.
The Foxconn offer consists of a layered remuneration deal similar to that of Nokia. Workers will get two months' salary for every year of service with a cap of 12 months, a lump sum of Rs 50,000, three months of notice period pay, the promised 2014 bonus of Rs 8,300, and a service awarded component of Rs 2,000 for every five years served.The average payout amount comes to Rs 3.26 lakh, higher than state-law advised Rs 1.56 lakh.
"This severance was floated of February 3. We have not paid them the January salary yet, which will be clubbed with the severance," said a top executive in the company who wished to remain unnamed. Foxconn had spent close to Rs 1.8 crore in January, a month that saw no production. The company had been paying for over 650 employees over the past few months when it had to cut production following Nokia's winding down.
Foxconn employees, who held a General Body Meeting this afternoon to discuss this offer, have decided to put the matter to a vote to ascertain inclination among workers to take up this offer.
The unions, which had been steadfast in their demand for jobs and factory re-opening, appear to have softened its stance. "Of course, the Centre for Indian trade unions wants the factory to keep running, but we also need to take into account majority opinion. If it falls in favour of severance, so be it," said Muthu Kumar, who is Joint President at Foxconn Employees Union, and represents CITU at Foxconn labour conciliations.
Another union member who wished to remain unnamed said that the reaction to this offer is mixed, with the majority disappointed with the size of the deal and another portion still rooting for job protection.
The factory exits occur at a time Tamil Nadu is gearing up to showcase itself to investors as a business-friendly state. "It does not matter which factory it is. If Foxconn is closing, it needs Government permission. If not, it has to keep paying its employees and find alternative clients," said a top official with the State labour Department.
However, Foxconn is navigating this labour tangle much along the lines of Nokia, which had floated a heftier severance package and brought employee count quickly under 100, the threshold for Industrial Disputes Act to kick in. "We have to wait and watch if the employees take this offer, because if they collectively don't, then the government will hold its stance that Foxconn should keep paying," the official said.
Foxconn has not replied to ET's queries on this development. In an earlier statement, it had said: "We continue to work with the government and the relevant labour unions to reach an amicable compensation arrangement that follows all applicable laws and regulations and is fair to all parties. Our company has been paying full salary to all employees during the conciliation and negotiation proceedings, despite the fact that the facility has ceased operations."
